Informed consent for companion animal genetic analysis services Koko Genetics™

This Consent explains the genetic analysis of the animal, its benefits, limitations, risks, and data uses. It is part of the contract along with the form and order summary, the Legal Terms, the Privacy Policy, the Cookie Policy, the Information Updates and Sample Repetition Policy, and the Returns, Shipping, and Replacements Policy. In the purchase and withdrawal, the Legal Terms prevail; in the analysis, the sample, and the voluntary decisions described herein, this document prevails; mandatory regulations always prevail.

1. Summary: the essential

This summary does not replace the full text. Read it in its entirety before registering or analyzing the kit.

• We analyze the DNA of your dog or cat from a mouth swab and deliver the modules included in the contracted product: breeds and ancestry, traits and, where applicable, variants associated with certain hereditary conditions, family tree, or genetic matches.
• The health result is an informative genetic screening, not a veterinary diagnosis. It does not confirm or rule out disease and is not 100% infallible.
• Even in monogenic conditions, detecting a variant does not allow one to state on its own that the animal is sick or will develop the condition; penetrance, expressivity, breed, other variants, age, and environment play a role.
• Before a clinical, pharmacological, nutritional, reproductive, sterilization, or euthanasia decision, consult a veterinarian and confirm the finding by an appropriate independent method.
• Estimates of race, family tree, and kinship depend on reference datasets and algorithms. They are not a pedigree, an official paternity test, or a breed or ownership certification.
• We analyze animal DNA. We do not interpret human DNA: if contamination is detected or a signal incompatible with a valid animal sample, we may reject it and apply the corresponding re-run protocol.
• The physical sample is normally destroyed within a maximum of two months from the completion of the analysis. Technical data are retained for as long as they are necessary to deliver, maintain and update the service, subject to your choices and rights.
• DNA Connect, internal research, academic research and development with companies are voluntary, separate, revocable functions and are never pre-marked.

2. Who provides the service

Koko Genetics, tellmeGen and Vivabioma are brands of GENELINK and may share corporate infrastructure and support channels. This does not authorize the combination of data from their services for new purposes. Any material combination requires prior information and a valid legal basis or, where applicable, a specific voluntary option.

The service is organized from Spain. The laboratories and other suppliers that process data on behalf of GENELINK are identified in the current list accessible from the Privacy Policy or by requesting it from support. Its substitution does not expand purposes or reduce rights.

3. What this service is and is not

3.1 Koko Genetics analyzes genetic markers present in an oral sample from your animal and generates the reports included in the accepted form and order. The technique, the number of markers, and the coverage may vary depending on the species, product, and version.

3.2 The purpose of the direct-to-consumer service is informative and educational, and it facilitates a documented conversation with the veterinarian.

A report from Koko Genetics is a genetic screening, not a veterinary diagnosis. It does not replace a veterinarian's examination, medical history, confirmatory testing, or judgment, and should not be used alone to initiate, suspend, or modify treatments, medication, feeding, or reproductive decisions.

3.3 The service is not designed to analyze a person's DNA. The results refer to the registered animal and do not establish a clinical relationship between GENELINK, the user, and the animal.

3.4 Enrollment is voluntary and does not require a veterinary prescription. If a modality is offered as a diagnostic veterinary test or under a specific professional circuit, its record will expressly identify it and its particular conditions will prevail.

4. Products, modules, and updates

4.1 The applicable product is the one identified in the form and the order summary. Depending on the species and modality, it may include:

Estimates of breed composition and ancestry.

Physical traits and genetic associations related to certain characteristics or sensitivities.

Variants associated with hereditary conditions and carrier status, when the product includes it.

Family Tree, estimated kinship, or DNA Connect, when available and activated according to this document.

Download of reports and of the raw data formats offered for the product.

4.2 The terms health, disease, risk, carrier, sensitivity, or predisposition describe genetic associations within the scope of the product; they are not, in themselves, a diagnosis, an individual clinical probability, or a therapeutic recommendation.

4.3 Interpretive updates and new features that the datasheet announces as free of charge will be incorporated at no additional cost within the contracted type, account, and plan, as long as the service is technically compatible and remains available. This does not include a new sample, another type, an independent product, a professional consultation, or a service that the datasheet identifies as separate.

4.4 An update may change the classification or interpretation of a marker without changing the analyzed DNA. Each report will show its version and date. A new treatment purpose or a new category of results that requires acceptance will not be activated retroactively without corresponding action.

5. Collection, identification, and processing

5.1 You must register the kit and collect the sample following the instructions, without the animal having eaten in the indicated period and avoiding contact with another animal or person. The laboratory extracts DNA, applies quality controls, and the software generates the reports.

5.2 The laboratory receives a unique identifier and does not need to access its name. GENELINK separately retains the information needed to link the result with the registered account and animal.

5.3 An insufficient quantity, food, microorganisms, animal mix, incorrect species, handling, temperature, transport or contamination may impede or distort the analysis. We may reject the sample, request information or repeat it according to the origin of the incident and the policy incorporated into the order.

5.4 The method is directed at the DNA of the analyzed species. We do not search for or interpret human DNA. If controls reveal an incompatible signal or relevant contamination, we will not issue human information and will eliminate unnecessary material and technical data as soon as reasonably possible, without prejudice to the minimum record for quality, safety, or claim.

5.5 We do not physically verify the identity of the animal. The report is attributed to the registered animal based on the sample and user declarations. The domestic chain of custody does not equate to a forensic or official chain of custody.

6. Reasonably expected benefits

To know estimates about breeds and ancestry and associations with certain traits.

Identify genetic findings that may warrant a discussion or confirmatory testing with the veterinarian.

Access, when activated, to kinship estimates and matches with other participating animals.

To keep a versioned report and, when appropriate, receive reinterpretations within the contracted scope.

7. Scientific and technical limitations

7.1 Health Screening, Penetrance, and Expressivity

A variant associated with a condition may have incomplete penetrance or variable expressivity. An animal may carry the variant and not get sick, get sick with different severity, or do so at another age. The absence of the analyzed variants does not rule out the disease or other variants of the same gene.

7.2 Races and ancestry

Breed composition is a statistical inference against reference populations. Underrepresented breeds, local populations, and highly admixed animals offer lower resolution. Percentages may vary between providers or versions and are not exact measurements or official certifications.

7.3 Family tree and lineage

The family tree is an algorithmic reconstruction compatible with DNA segments and reference populations; it does not necessarily identify real progenitors. An official paternity test requires samples from the relevant animals, a validated method, and proper identification and chain of custody.

7.4 DNA Connect and kinship

The amount of shared DNA allows for the estimation of relationships, but several relationships can produce similar percentages. Inbreeding, a very homogeneous breed, population structure, data quality, and database size can generate ambiguous, undetected, or erroneous matches.

7.5 Traits, behavior, and drug sensitivity

Traits are associations and do not reflect the entire observable characteristic. Behavior depends especially on socialization, learning, environment, and handling. A result related to drug response does not authorize administering, withdrawing, or adjusting medication without a veterinarian and confirmation when appropriate.

7.6 Scope of the technique

The product analyzes a defined set of markers and not the entire genome for clinical purposes. It may not detect rare, novel, structural, uncovered, or version-excluded variants. The clinical validity of an association may differ between races and species.

7.7 False positives, false negatives, and uninterpretable data

No technique is infallible. A finding may be obtained that is not confirmed, a present variant may not be detected, or sufficient quality may not be achieved. Controls reduce the risk, but do not eliminate it. Therefore, we do not guarantee 100% accuracy or a concrete result.

7.8 Evolution of the evidence

The classification of a variant, breed, or kinship can change with new publications, reference samples, or algorithms. We can update reports, but we do not assume the obligation to individually notify of every scientific change; however, we will communicate known material errors that affect a result issued pursuant to section 10.

7.9 Raw data and third-party services

Raw data is a technical output, may contain incomplete or unvalidated calls, and does not equate to a clinical report. Third-party tools may produce different interpretations. GENELINK does not control those services nor is responsible for their security, compatibility, or conclusions.

7.10 Security

We apply strict technical and organizational measures, but no information system is completely immune to risks.

8. Before veterinary, reproductive, or welfare decisions

8.1 Before acting on a health result, a veterinarian must evaluate it along with the species, breed, age, examination, clinical history, signs, medication, and history. When the decision depends on a specific variant, it must be confirmed in a new sample by an appropriate independent method chosen by the professional.

8.2 Do not make decisions about diagnosis, treatment, medication, therapeutic diet, sterilization, reproductive exclusion, abandonment, surrender, insurance, or euthanasia based solely on this service. Euthanasia and other actions subject to veterinary control can only be decided in accordance with the law and the individual well-being of the animal.

8.3 If you use genetic information in breeding, do so with veterinary or animal genetics advice, confirmation and assessment of genetic diversity, welfare and applicable regulations. Systematically eliminating animals for a single marker can harm the population or breed.

8.4 To the extent that the damage does not arise from its own breach, GENELINK is not liable for decisions contrary to these precautions or for the independent interpretation made by third parties.

9. Preliminary information, materials and support

9.1 Before registering the kit, you will have access to this Consent, the product sheet and limitations, the legal Terms, and the Privacy Policy. The order summary identifies the contracted modality. The FAQs and educational materials help understand the service, but they do not eliminate these limitations nor do they substitute a specific contractual description.

9.2 The platform may offer guides, glossaries, and scientific sources. Their availability does not constitute veterinary advice, nor does it guarantee that each publication is applicable to the specific animal.

9.3 If a professional consultation is offered, your record will identify the provider, qualification, purpose, price, country, and conditions. It is not an emergency service. If you notice signs of illness, consult a veterinarian without waiting for the result.

10. Unexpected findings, versions, and corrections

10.1 You may learn unexpected information about race, kinship, or health. It may be distressing, affect relationships with breeders, vendors or other holders, and once learned or shared, cannot be unlearned or removed from third-party copies.

10.2 When the platform allows, you may decide not to open a category before viewing it. That option does not prevent necessary technical controls or error correction, and may not be available if the category is an essential part of the chosen product.

10.3 If we identify a material error affecting an issued result, we may temporarily withdraw it, correct it, issue an identified version, and communicate it to you. Where reasonable, we will retain the version trail or allow the superseded copy to be downloaded marked as such.

10.4 A reinterpretation due to new evidence does not mean that the original sample or data were flawed. The date and version allow for distinguishing a correction from a scientific update.

11. Responsible Use and Prohibited Uses

11.1 Reports, data, and coincidences shall not be used or furnished for:

Justify abandonment, rejection, mistreatment, euthanasia, sterilization or any irreversible decision about welfare without veterinary criteria and legal basis.

To substitute a diagnosis, a confirmatory test, a prescription, or treatment indicated by a veterinarian.

To accredit breed, pedigree, lineage, identity, ownership, reproductive fitness, or commercial value to clubs, authorities, insurers, courts, or buyers when official proof is required.

To price, exclude, or underwrite insurance; discriminate; select animals in a manner contrary to their welfare; or make employment, credit, or personal decisions.

Submit an alien, substituted, mixed, or un-authorized sample; manipulate a result; impersonate an account; or use DNA Connect for harassment, fraud, unsolicited advertising, or mass data extraction.

Attempt to identify a person through incidental contamination, re-identify data, violate controls or reconstruct databases, algorithms or models except for an inalienable legal right.

11.2 We may suspend processing or access when there is reasonable suspicion of fraud, unauthorized disclosure, risk to third parties, prohibited use, or serious breach, applying a necessary and proportionate measure and requesting accreditation when appropriate.

12. Who can register a sample

12.1 You must be 18 years old and have contractual capacity. You declare yourself to be the owner or legitimate guardian of the animal, or to have sufficient authorization from whoever is, and to have the authority to send the sample and receive the results.

12.2 Mere occasional care, physical access to the animal, prior breeder status, clinic, shelter, insurer, prospective buyer, or family member does not alone establish such authorization. We may request documentation or block the kit if there is a reasonable dispute.

12.3 In gifts and multiple orders, the payer does not authorize the analysis nor automatically access results. The person who registers each animal must use their account and accept this document.

12.4 Professional clients, clinics, breeders, and shelters are also governed by their professional contract, including the authentication of each sample, information to the owner, chain of custody, and division of responsibilities.

13. Physical exhibit

13.1 The sample is used to provide the analysis and perform technical identity, quality, repetition, safety, and incident resolution controls. It is not used for cloning, assisted reproduction, genetic editing, or physical research unless separate consent and an identified project are obtained.

13.2 Saliva and DNA residues are normally destroyed within two months of the completion of the analysis. A repeat, claim, quality investigation, or legal requirement may justify further limited retention; they will be destroyed once the cause ceases.

13.3 The sample is not incorporated into a biobank nor transferred for other purposes by these data options. An investigative use of the physical sample would require another document, project information, and the applicable legal regime.

21. Change of control, restructuring, and continuity

21.1 GENELINK may merge, spin off, finance, reorganize, or transfer the Koko Genetics business or brand. In the preliminary negotiation and audit phases, only strictly necessary aggregated, statistical, or pseudonymized data may be shared, under confidentiality, minimization, and access control agreements. In no case will individually identifiable records or genetic profiles attributable to an animal and its owner be provided.

21.2 If the operation is completed, the successor shall be subrogated as the data controller and shall be bound by this Consent and by the preferences you have configured, without expanding the purposes. We will inform you without undue delay and, whenever possible, before the successor begins to process your data, indicating their identity and contact details; you may then withdraw your voluntary choices, export your data, or request its deletion. This clause does not authorize an autonomous sale of samples or personal data.

21.3 A materially new purpose will require its own legal basis and information. If there is no continuity, the data will be returned, deleted, anonymized or blocked as appropriate.

15. Genetic data from another provider

15.1 When uploading is permitted, you grant us the necessary technical faculties to store, convert, analyze, and display the file within the requested service. You declare that it corresponds to the indicated animal and that you are authorized to provide it.

15.2 We do not verify the identity of the animal, chain of custody, technique, coverage, quality or integrity of the origin provider. The file may be incompatible, incomplete, contain errors, or allow for fewer reports.

15.3 We can reject malicious, altered, unauthorized, or incompatible files. Scientific limitations apply more intensely and no conclusion should be presented as validation of the original analysis.

16. Share Reports and Professional Access

16.1 You decide if you share. When Professional Access is offered, you must identify the recipient, scope, and duration. Authorization is requested upon activation and can be revoked; it is not presumed from this document.

16.2 Revocation blocks future access from the platform, but does not delete copies already downloaded or lawfully incorporated into the recipient's medical record or file.

16.3 GENELINK is responsible for the operation of its platform. The veterinarian or third party is responsible for their authorization, confidentiality, interpretation, decisions, and subsequent conservation, unless the record expressly identifies them as a professional hired by GENELINK.

16.4 Links or files shared outside the official function may lose access controls. Verify the recipient and avoid insecure channels.

17. DNA Connect and genetic matching (voluntary)

17.1 DNA Connect is deactivated unless activated by you via a separate option. By activating it, you authorize that the animal's markers are continuously compared with those of other participating animals and that new matches are generated as the base grows or changes.

17.2 Before activating it, it will be shown which profile elements other users will see, which data is mandatory and which is optional, how messaging works, and what contact controls exist. Your contact details will not be revealed without further unequivocal action.

17.3 A match is an estimate, not official proof of parentage. It may reveal litters, breeders, adoptions, sales, or relationships you didn't expect. Other users may contribute false information or misinterpret the match.

17.4 You can disable it at any time. New visible comparisons will stop and the profile will be removed from the active index within a reasonable technical timeframe. Disabling does not remove notifications, messages, screenshots, or data that another user has already lawfully received.

17.5 We do not guarantee that relatives exist, that they will appear immediately, that a match will remain stable, or that another user will respond. We may moderate, limit, or suspend accounts or messages for security, fraud, or abuse.

18. Research, Development, and Artificial Intelligence (voluntary)

18.1 Participation is authorized through a single checkbox, separate from the main consent and revocable at any time. If granted, technical data of the animal, reports, questionnaires, and minimum metadata may be processed for:

(a) Internal research and improvement: validate and refine Koko Genetics algorithms, reference bases, reports, controls, and models, including training and evaluation of artificial intelligence systems.

(b) External scientific projects with universities, veterinary faculties, research centers, or non-profit entities.

(c) Research, validation, or development with companies and commercial collaborators in genetics, veterinary health, nutrition, animal welfare, or biotechnology.

18.2 The current information on research lines and collaborator types will be available in the legal or privacy area of Koko Genetics or can be requested from support. A project exceeding these categories will require new information and the corresponding legal basis.

18.3 As long as the data is linked to your account, it will be used in a minimized and pseudonymized manner. Collaborators do not receive your identity unless a project explains it and you authorize it separately. Irreversibly anonymized data can no longer be associated with you.

18.4 This authorization does not include the physical sample, DNA Connect, commercial communications, Professional Access, or the combination with tellmeGen or Vivabioma; each requires its own basis and, where applicable, separate action.

18.5 Projects may generate publications, databases, algorithms, models, patents, products, licenses, or revenues. Unless there is a specific written agreement, you do not acquire ownership, royalties, or the right to approve of aggregated results or developments.

18.6 You can withdraw authorization just as easily as you granted it. New inclusions and future treatments based on it will stop, but withdrawal does not invalidate lawful operations already performed, publications, irreversibly anonymized data, nor does it allow for the individual untraining of consolidated models that do not retain a recoverable copy of their record.

19. Personal data protection

19.1 Responsible. GENELINK, S.L., with the data from section 2.

19.2 Nature of the data. The animal's DNA, considered in isolation, is not genetic data of a natural person in the sense of the GDPR. However, the kit code, ownership or care of the animal, the account, contacts, messages, questionnaires, and linked results may constitute personal data about you or other individuals. They are processed in accordance with the GDPR. Any incidental human signal is not interpreted or incorporated into a report.

19.3 Categories. Identification and contact; contracting and billing; account and security; declared animal data; sample and identifier; technical data, reports and versions; external uploads; questionnaires; preferences; communications; DNA Connect and messaging if activated; and necessary usage logs.

19.4 Purposes and legal bases:

To provide what was contracted, manage the sample, reports, updates included, support and downloads: contract execution.

Prevent fraud, protect the platform, investigate incidents and defend claims: legitimate interest, subject to weighing.

Fulfill tax, accounting, consumer, safety, and quality obligations: legal obligation.

DNA Connect, internal AI research, external scientific research and commercial development: the specific option granted for each category, when personal data is processed.

Commercial communications: consent or legal enablement for similar products, always with a simple opt-out in each shipment.

19.5 Recipients and transfers. Laboratories, infrastructure, accommodation, logistics, payments, messaging and support operate under the relevant contract or legal position. The current list, location and guarantees of any international transfer are shown in the Privacy Policy. We do not claim that every provider is always in the EEA if the current list indicates otherwise.

19.6 Conservation. The sample is governed by section 13; accounts, reports and options by section 14; invoicing and contractual proof by statutory deadlines; incidents by the time necessary to manage them and defend responsibilities.

19.7 Automation. The software relates markers with rules, bases, and models and generates reports and matches. That automation does not make legal decisions about you. You can request an explanation of the scope or a review of a possible material error; this does not turn the service into veterinary advice nor does it guarantee a reinterpretation upon request.

19.8 Rights. Regarding your personal data you may request access, rectification, erasure, restriction, objection, and portability where applicable, and withdraw any of the voluntary authorizations you have granted, by writing to lopd@tellmegen.com. We may ask for proportional identity verification. You may lodge a complaint with the supervisory authority.

19.9 Security. We apply technical and organizational measures appropriate to the risk, including logical separation of identifiers, access control, logging, communication protection, continuity, and incident management as appropriate. No system is absolutely secure. Breaches will be managed and reported when required by law.

20. Responsibility

20.1 GENELINK undertakes to provide the service in accordance with the order, this Consent, applicable controls, and the technique described. It does not guarantee a specific breed, variant, family, percentage, diagnosis, benefit, or outcome when the nature of the service prevents such a guarantee.

20.2 To the extent that the damage does not arise from our own breach, we are not liable for misidentified or miscollected samples; false user information; decisions contrary to section 8; third-party interpretations or services; external files; prohibited uses; voluntary disclosure; nor actions of other participants in DNA Connect.

20.3 Nothing limits liability for intent or gross negligence, death or personal injury caused by negligence, defective products, lack of conformity, essential obligations, attributable breach of data or confidentiality, nor mandatory consumer rights. For non-consumer clients, limits shall be governed by their professional contract.

22. Territorial availability

22.1 Availability depends on country of residence, purchase, delivery, sample return, species, laboratory, and location of results access. We may prevent hiring, adapt logistics, remove a module, or suspend it when we cannot meet local, security, or provider requirements.

22.2 You must provide your actual location and use the authorized circuit. You must not reship a kit or sample between countries, alter labels, use a false address, or evade controls. Costs or losses attributable to an unauthorized circuit are governed by the Legal Terms.

23. Withdrawal and early commencement

The right of withdrawal is 14 calendar days. Withdrawal, returns, and service execution are governed by the Legal Terms, by the Return Policy, and by law. Unsealing may exclude the return of the physical component for hygiene reasons, but it does not in itself eliminate rights over uninitiated services. This Consent does not constitute a request for commencement during the withdrawal period nor an acknowledgment of loss of rights; these actions are requested separately.

24. Incidents, claims, and security

Report errors, samples, access, matches, or uses that may affect quality, safety, or well-being to info@kokogenetics.com. We can investigate, request a new sample, block access, moderate DNA Connect, withdraw or reissue reports, and communicate with authorities when obligated. You can go to consumer protection, data protection, or the competent authority.

25. Modifications and version

25.1 We may publish new versions for future hires or for legal, technical, scientific, security, or product changes. The version shown and recorded upon acceptance will remain proof of your decision.

25.2 We will not retroactively expand a voluntary purpose nor activate DNA Connect or research by silence. If a change requires new acceptance, that function will be blocked until you act.

25.3 You can consult or request the accepted version from your account or via support, and request the version history at info@kokogenetics.com.

26. Languages, law and jurisdiction

26.1 The original is in Spanish. Translations facilitate understanding. In case of discrepancy, the contracted version or the solution required by the mandatory rules of the consumer's country shall prevail.

26.2 Spanish legislation applies, including Regulation (EU) 2016/679 and Organic Law 3/2018, without depriving the consumer of mandatory protection nor of the courts corresponding to their habitual residence.

27. Electronic record

We register the account, linked animal and kit; product, country, language, and version; text fingerprint; date and time; and each acceptance, activation, modification, and withdrawal. The registration is a means of proof, not an irrefutable presumption, and you can download your copy from the account or request it from support.

Consents

The checkboxes are presented independently and none are pre-ticked. Only the first is mandatory; the others are voluntary, revocable at any time, and do not affect the contracted service or its price.

☐ Mandatory. I have read and accept the Informed Consent and the Terms and Conditions, and I give my explicit consent for Koko Genetics to analyze my pet's sample and process the data resulting from the analysis in order to provide me with the service. I declare to be over 18 years of age and to be the owner or legitimate guardian of the animal, or to have sufficient authorization from whoever is.

☐ Voluntary. I want to advance science and knowledge about animal health: I authorize the use of my pet's analysis data, in a pseudonymized or aggregated form, in research projects. I understand that this includes collaborations and commercial agreements with universities, research centers, and companies, and the development and training of artificial intelligence models. Information that directly identifies me will not be shared, I will be able to withdraw this authorization at any time, and my decision will not affect the contracted service.

☐ Voluntaria. I wish to receive updates, news, and special offers from Koko Genetics. I can unsubscribe at any time.

☐ Voluntary. I wish to activate the DNA Connect function to find potential relatives of my pet within the Koko Genetics community. I understand that my pet will only be compared with other pets whose owners have also activated this option, that a match is an estimation and not proof of kinship, and that I can activate or deactivate it at any time from my account.

Professional Access, use of the physical sample, and the combination of data with another GENELINK service are not authorized here: each requires separate and specific consent at the appropriate time.

Appendix. Glossary

DNA. Molecule that contains genetic information inherited from parents.

Marker or variant. Position or difference in the DNA analyzed by the technique. It can be harmless or associated with a trait or condition.

Genetic screening. Analysis that searches for defined markers to guide or inform; it is not equivalent to a diagnosis nor does it rule out what is outside its scope.

Penetrance. Proportion of animals with a variant that exhibit the associated trait or condition.

Expressiveness. Variable degree or form in which a condition manifests in animals with the same variant.

Carrier. Animal with a variant that it can transmit and may not manifest the condition.

Breed composition. Statistical estimation versus reference populations; no official certification.

Pseudonymization. Separation of identifiers by means of a code; it remains personal data if it can be reversed with additional information.

Anonymization. Irreversible process after which data can no longer be associated with an identified or identifiable person by reasonable means.
